These Terms of Service ("Terms") govern your use of the Clothella application ("the App") for Shopify, provided by Clothella ("we", "us", or "our"). By installing or using the App, you agree to these Terms. If you do not agree, please do not install or use the App.
1. The Service
The App provides AI-powered virtual try-on for Shopify stores, letting shoppers generate a preview of how a product may look on them. The App is offered on a subscription basis with usage limits that vary by plan.
2. Eligibility
The App is intended for use by merchants operating a Shopify store. You are responsible for complying with Shopify's policies and all laws that apply to your store and its content.
3. Billing
Subscription fees and any usage-based charges are billed through Shopify and are subject to Shopify's billing terms. Plan pricing and limits are shown in the App and on the Shopify App Store. You may cancel at any time by uninstalling the App; charges already incurred are handled according to Shopify's billing rules.
4. Acceptable Use
You agree not to use the App to:
- Upload or process content that is unlawful, infringing, or that you lack the rights to use
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the App
- Use the App in a way that violates Shopify's terms or any applicable law
5. Content & Images
Images uploaded or generated through the App are processed solely to provide the try-on feature, as described in our Privacy Policy. You are responsible for ensuring that images used in your store, and any try-on experience you enable, comply with applicable laws and the rights of the individuals shown.
6. AI-Generated Results
Try-on images are generated by automated AI models and are an approximation for visual reference only. They may not accurately represent fit, size, color, or appearance. We make no guarantee as to the accuracy or suitability of generated results, and they should not be the sole basis for a purchase decision.
7. Third-Party Services
The App relies on Shopify and a third-party AI image-generation service to function. Your use of the App is also subject to Shopify's Terms of Service. We are not responsible for the availability or performance of third-party services.
8. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that results will meet your expectations.
9. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or for any loss of profits, revenue, or data, arising out of your use of the App.
10. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate access if these Terms are violated or if required to protect the service or comply with law. On uninstall, data is handled as described in our Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the updated Terms.
